These Terms of Service (“Terms”) govern your access to and use of the online store operated by DRAPEHOUSE LTD (“DRAPEHOUSE”, “we”, “us” or “our”), including the purchase of curtains, blinds, accessories and other products offered through our Store.

By accessing our Store, placing an order or purchasing products from us, you agree to these Terms to the extent applicable.

Nothing in these Terms is intended to exclude, restrict or replace any statutory rights or remedies that cannot lawfully be excluded under applicable UK consumer law.

DRAPEHOUSE LTD is the seller responsible for orders placed through the Store unless expressly stated otherwise.

We may use third-party suppliers, manufacturers, warehouses, fulfilment providers, payment providers and delivery companies in connection with fulfilling orders.

2. OUR ONLINE STORE

Our Store allows customers to browse and purchase curtains, blinds, curtain accessories, fittings, hardware and other home furnishing products that we make available from time to time.

Our products may include:

  • ready-made curtains;

  • blackout curtains;

  • made-to-measure curtains;

  • fabric blinds;

  • made-to-measure blinds;

  • curtain accessories;

  • curtain hooks and rings;

  • brackets and fittings;

  • curtain hardware; and

  • other related products.

Products available through the Store may change without notice.

The Store is hosted using Shopify, which provides ecommerce technology that enables us to offer products and services online.

3. ELIGIBILITY

By placing an order through the Store, you confirm that you have legal capacity to enter into a binding contract.

If you place an order on behalf of a company or other organisation, you confirm that you have authority to act on behalf of that organisation.

Different rights may apply depending on whether you purchase as a consumer or for purposes wholly or mainly related to your trade, business, craft or profession.

4. PRODUCT INFORMATION

We take reasonable care to ensure that product descriptions, specifications, dimensions, images and other information displayed on the Store are accurate.

However, minor differences may occur.

Images are provided primarily for illustrative purposes. The appearance of colours, fabrics and textures may vary depending on:

  • lighting;

  • photography;

  • screen settings;

  • device display;

  • monitor calibration;

  • manufacturing tolerances; and

  • natural characteristics of textile materials.

For textile products, minor variations in colour, weave, texture, pattern placement or finish may occur where these are inherent characteristics of the relevant material.

Such minor variations do not necessarily constitute a defect.

Nothing in this section affects your statutory rights where goods are materially different from their description or otherwise fail to conform to the contract.

5. PRODUCT DIMENSIONS

Product dimensions are provided on the relevant product page where applicable.

Customers should carefully check dimensions before ordering.

For ready-made products, minor manufacturing tolerances may apply where reasonable for the type of product concerned.

For made-to-measure products, the measurements and specifications accepted as part of the order will be used to manufacture or arrange manufacture of the product.

6. MADE-TO-MEASURE AND CUSTOM PRODUCTS

Certain curtains, blinds and related products may be manufactured, cut, altered or otherwise prepared specifically according to measurements, specifications or selections supplied by you.

These may include:

  • made-to-measure curtains;

  • made-to-measure blinds;

  • products manufactured to dimensions supplied by you;

  • fabric cut specifically for your order;

  • products manufactured in a particular configuration;

  • personalised products; and

  • other bespoke products.

You are responsible for checking all measurements, dimensions, colours, fabrics, fitting types and other specifications before submitting your order.

Once a made-to-measure or personalised product enters production, it may not be possible to modify or cancel the order.

Goods made to your specifications or clearly personalised may also be excluded from the statutory change-of-mind cancellation right applicable to certain distance contracts.

This does not affect your statutory rights if a made-to-measure product is faulty, damaged, incorrectly manufactured, not as described or otherwise fails to conform to the contract.

7. CUSTOMER MEASUREMENTS

Where a product is manufactured according to measurements provided by you, you are responsible for ensuring those measurements are accurate.

Before ordering, you should:

  • measure the relevant area carefully;

  • follow any measurement guidance we provide;

  • verify measurements before submitting them;

  • select the correct measurement units;

  • check the intended fitting method; and

  • review all dimensions shown in your order before payment.

Where a product has been correctly manufactured according to measurements or specifications supplied by you, we will not normally be responsible solely because it does not fit the intended space as a result of incorrect customer-supplied measurements.

This does not apply where the error was caused by us or the product supplied does not correspond with the measurements or specifications accepted by us.

8. FABRIC SAMPLES

Where fabric samples are available, we may recommend ordering or reviewing a sample before purchasing made-to-measure curtains or blinds where exact colour or texture is important.

A digital representation of fabric cannot always reproduce the exact appearance of the physical material.

Different production batches may also exhibit reasonable variations inherent in textile manufacturing.

Nothing in this section affects your statutory rights.

9. PRICES

Prices displayed through the Store are shown in the currency indicated at checkout.

The total amount payable will be displayed before you submit your order.

Any applicable taxes, delivery charges or other charges will be shown or calculated as required during the checkout process.

We may change product prices at any time.

Price changes will not normally affect orders for which a binding contract has already been formed.

If a pricing error is identified before we accept an order, we may contact you to explain the error and give you an opportunity to purchase at the correct price or cancel the order.

We will not intentionally use pricing provisions to deprive consumers of rights provided by law.

10. ORDERS

When you place an order, you are making an offer to purchase the products included in that order.

Submitting an order does not necessarily mean that we have accepted it.

After you place an order, you may receive an automated acknowledgement confirming that we have received it.

An acknowledgement of receipt is not necessarily acceptance of your order.

A binding contract is formed when we accept your order, which may occur when we send an order confirmation or otherwise confirm acceptance.

11. RIGHT TO REFUSE OR CANCEL AN ORDER

We may refuse or cancel an order where reasonably necessary, including where:

  • a product is unavailable;

  • information required to process the order is incomplete;

  • payment cannot be authorised;

  • we reasonably suspect fraud or unauthorised activity;

  • an obvious pricing or product information error has occurred;

  • we cannot deliver to the requested address;

  • a technical error prevents fulfilment; or

  • accepting the order would breach applicable law.

Where we cancel an order after payment has been taken and you are entitled to repayment, we will refund the relevant amount.

12. PAYMENT

Payment must be made using a payment method available through the Store.

Payments may be processed by Shopify and/or third-party payment providers.

By submitting payment information, you confirm that you are authorised to use the selected payment method.

We do not necessarily receive or directly store complete payment card information.

Orders may be subject to payment authorisation, fraud screening and security checks.

13. SHIPPING AND DELIVERY

Available delivery options, estimated delivery times and applicable charges will be displayed through the Store or otherwise communicated to you.

Delivery estimates are estimates unless we expressly agree to a specific binding delivery deadline.

Products may be dispatched from third-party suppliers, manufacturers, warehouses or fulfilment centres.

As a result:

  • different products may be dispatched from different locations;

  • an order may arrive in more than one parcel;

  • different parcels may arrive on different dates; and

  • tracking information may be issued separately.

Nothing in these Terms limits rights you may have under applicable law regarding delivery.

14. DELIVERY INFORMATION

You are responsible for providing complete and accurate delivery information.

Please check your:

  • recipient name;

  • street address;

  • building or apartment information;

  • city;

  • postcode;

  • country; and

  • relevant contact details

before submitting your order.

We cannot guarantee that an address can be changed after an order has entered processing or been dispatched.

15. FULFILMENT PARTNERS

DRAPEHOUSE LTD may use third-party suppliers, manufacturers, warehouses, fulfilment companies and logistics providers.

These parties may perform services including:

  • manufacturing;

  • storage;

  • picking;

  • packing;

  • dispatch;

  • transportation;

  • returns processing; and

  • product inspection.

The use of third-party fulfilment providers does not, by itself, change the identity of the seller or remove statutory obligations that DRAPEHOUSE LTD owes to consumers.

16. RISK AND OWNERSHIP

Risk in goods will pass in accordance with applicable law.

For consumer purchases, where goods are delivered using a carrier arranged by us, the risk of loss or damage generally remains with us until the goods come into your physical possession or that of a person you identified to receive them, subject to applicable law.

Ownership of goods will pass in accordance with the applicable contract and law.

17. INSPECTION OF GOODS

Please inspect your products as soon as reasonably possible after delivery.

Where possible, provide your order number, a description of the issue and clear photographs showing the product and packaging.

Prompt notification may help us investigate issues with the relevant warehouse, supplier or carrier.

Failure to report an issue immediately does not automatically remove statutory rights you may have.

18. RETURNS, REFUNDS AND CANCELLATIONS

Returns, refunds and cancellations are governed by our Refund Policy and applicable law.

For eligible standard goods purchased online, consumers may have a statutory right to cancel within the applicable cancellation period.

Different rules may apply to goods made to your specifications or clearly personalised, including made-to-measure curtains and blinds.

Our Refund Policy forms part of the terms applicable to purchases through the Store.

Nothing in that policy or these Terms limits rights that cannot lawfully be excluded.

19. FAULTY OR MISDESCRIBED GOODS

Goods supplied to consumers must satisfy applicable statutory requirements.

Depending on the circumstances, this includes requirements that goods be:

  • of satisfactory quality;

  • fit for applicable purposes; and

  • as described.

If goods fail to conform to applicable legal requirements, you may have statutory remedies, including rights relating to rejection, repair, replacement, price reduction or refund.

20. INSTALLATION

Unless expressly stated otherwise, products are supplied without professional installation services.

You are responsible for ensuring that curtains, blinds, rails, brackets, fittings and related products are installed appropriately and safely.

Where installation requires drilling, tools, specialist knowledge or assessment of walls, ceilings or other structures, you should use an appropriately competent person if necessary.

Always follow installation instructions supplied with the product.

We are not responsible for damage caused solely by incorrect installation, misuse or failure to follow applicable instructions where such damage was not caused by a defect in the product.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

21. CHILD SAFETY AND BLIND CORDS

Some blinds, curtain systems or window-covering products may contain cords, chains or other components that can present safety risks if improperly installed or used, particularly around young children.

Any safety devices or installation instructions supplied with the product should be installed and followed correctly.

Do not remove or disable safety devices.

Customers are responsible for following safety and installation instructions supplied with the product.

Nothing in this section removes obligations imposed on us by applicable product safety law.

22. ACCEPTABLE USE OF THE STORE

You must not misuse our Store.

You must not knowingly:

  • use the Store for unlawful purposes;

  • introduce viruses, malicious code or harmful technology;

  • attempt unauthorised access to the Store or related systems;

  • interfere with the operation or security of the Store;

  • use automated systems to abuse Store functionality;

  • impersonate another person;

  • submit fraudulent orders; or

  • use the Store in a way that infringes the rights of others.

We may take reasonable measures to protect the Store, customers and our business from misuse.

Nothing in these Terms transfers intellectual property rights to you.

You may use the Store for your personal and lawful purposes.

You may not reproduce, commercially exploit, republish or distribute protected Store content without permission where such permission is legally required.

24. CUSTOMER REVIEWS AND USER CONTENT

Where the Store allows you to submit reviews, photographs, comments or other content, you are responsible for content you submit.

You must not knowingly submit content that:

  • is unlawful;

  • is fraudulent or misleading;

  • infringes another person's intellectual property rights;

  • contains malicious code;

  • unlawfully discloses another person's personal information; or

  • promotions may apply only to specified products;

  • minimum order requirements may apply;

  • some products may be excluded;

  • promotional codes may not be combined; and

  • promotions cannot normally be applied retrospectively to completed purchases.

Specific promotional terms displayed with an offer will apply to that promotion.

Nothing in promotional terms affects statutory consumer rights.

28. AVAILABILITY

Products are subject to availability.

Adding a product to your shopping cart does not reserve it.

If a product becomes unavailable after an order is placed, we may contact you and, where appropriate, offer an alternative, revised delivery arrangement or cancellation.

We will not substitute a materially different product without your agreement where agreement is legally required.

29. EVENTS OUTSIDE OUR REASONABLE CONTROL

There may be circumstances outside our reasonable control that affect our ability to perform our obligations, including severe weather, transportation disruption, natural disasters, governmental actions, widespread network or infrastructure failures and similar events.

Where such circumstances occur, we will take reasonable steps appropriate to the situation.

This section does not remove rights or remedies that you have under applicable consumer law, including rights relating to delayed delivery or cancellation where applicable.

30. OUR LIABILITY

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

In particular, nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence where liability cannot lawfully be excluded;

  • fraud or fraudulent misrepresentation; or

  • breach of statutory consumer rights that cannot lawfully be excluded.

If you are a consumer, we are responsible for losses that are a foreseeable consequence of our breach of contract or failure to use reasonable care and skill, subject to applicable law.

We are not responsible for losses that were not reasonably foreseeable, except where applicable law provides otherwise.

If you use products primarily for business purposes, different liability rules may apply.

31. BUSINESS CUSTOMERS

If you purchase products wholly or mainly for purposes relating to your trade, business, craft or profession, you are purchasing as a business customer rather than as a consumer.

Certain statutory consumer protections, including some cancellation rights, may therefore not apply.

Where separate business terms have been agreed between DRAPEHOUSE LTD and a business customer, those terms may supplement or replace relevant provisions of these Terms.

32. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to:

  • our fulfilment arrangements;

  • applicable law; or

The version applicable to your purchase will generally be the version in effect when the relevant contract is formed, except where changes are required by law or otherwise lawfully apply.

The “Last updated” date at the beginning of these Terms indicates when this version was most recently updated.

33. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Any invalid provision will be treated as modified or removed only to the extent necessary.

34. NO WAIVER

If we delay or fail to enforce a provision of these Terms, this does not necessarily mean that we have waived our right to enforce that provision later.

35. ENTIRE AGREEMENT

These Terms, together with our applicable Refund Policy, Privacy Policy, Shipping Policy and information provided as part of the ordering process, constitute the terms applicable to your use of the Store and purchases, subject to any additional terms expressly agreed between you and DRAPEHOUSE LTD.

Nothing in this section excludes representations, rights or obligations that cannot lawfully be excluded.

36. GOVERNING LAW

These Terms and contracts for purchases through our Store are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply to you.

If you are a consumer resident elsewhere in the United Kingdom, you may also benefit from mandatory protections applicable in the part of the United Kingdom where you live.

37. DISPUTES AND JURISDICTION

Nothing in these Terms restricts a consumer's right to bring proceedings in a court that has jurisdiction under applicable law.

If you are a consumer living in England or Wales, proceedings may generally be brought in the courts of England and Wales.

Consumers living in Scotland or Northern Ireland may have rights to bring proceedings in their local courts as provided by applicable law.
